New Electronic Voting
In October 2024, Governor Newsom signed AB 2159, making it possible for California HOAs and POAs to vote electronically for the first time ever. With over 50,000 homeowners' associations across the state, many are transitioning to electronic voting this year. This exciting change is expected to make it easier for members to vote, for associations to reach quorum, and could help reduce election costs over time. Here's everything you need to know:
What This Means For You
- All homeowners are automatically opted in for electronic voting.
- Prefer paper ballots? No problem! You can opt-out online at www.hoaelections.net/votepreference and select to vote by mail.
- How Does It Work? Homeowners opted into electronic voting, will receive an email with a secure link to cast their vote during elections. Homeowners opted ino print voting will receive a traditional paper ballot to cast their vote with.
Key Dates
- January 7, 2025: The Board passed the new Election Rules to introduce electronic voting.
- January 13, 2025: HOA Elections mailed all homeowners a notice detailing the electronic voting process. This notice confirms your enrollment in electronic voting and provides the specific email address to which your unique voting link will be sent. Homeowners who prefer to vote using a paper ballot, must notify HOA Elections by February 14, 2025 to opt out of electronic voting online at www.hoaelections.net/votepreference.
- February 14, 2025: Last day to change your voting preference with HOA Elections. Homeowners may update their preference online at www.hoaelections.net/votepreference.
Candidate Information
In 2024, the Canyon Lake POA's Bylaws were amended to extend the terms of Board Members to four years, with the intent of elections being held every other year. To align the new terms with the new election scheduled, so elections are held every other year, three Board Members will be elected for a three-year term in the 2025 election. Starting in 2026, Board Member terms will be extended to four years.
- 2025: 3 Directors Elected for a 3-Year Term–Ending in 2028
- 2026: 2 Directors Elected for a 4-Year Term–Ending in 2030
- 2028: 3 Directors Elected for a 4-Year Term–Ending in 2032
- 2029: No Election
Notice of Intent To Run Forms
Three of the five seats on the Canyon Lake POA Board of Directors are up for election this year. "Notice of Intent to Run" packets will be available at the Canyon Lake POA offices starting on January 31, 2025. Forms must be completed and returned to the Clerk of the Board in the Canyon Lake POA Corporate office no later than 3 p.m. on Monday, March 3, 2025.

2024 Annual Meeting & Election of Directors
The Canyon Lake POA has a five-member Board of Directors who are collectively responsible for managing and operating the Canyon Lake POA’s business affairs. The Board of Directors are elected for staggered terms by Canyon Lake homeowners. The Board of Directors works closely with the Canyon Lake POA’s Corporate Department to ensure that Canyon Lake POA duties and responsibilities are being carried out. Annual Elections are held in May of each year for Board Directors.

2024 Ballot Measures
Restrict Future Sales of Common Areas
A majority vote to approve this measure would result in the Board being unable to sell common areas without the approval of the Canyon Lake owners. If approved, future common area sales would require a quorum and majority vote in favor at a meeting or election conducted in accordance with California law and Canyon Lake POA governing documents.
Results: 964 in favor, and 105 against. This measure passed as a majority supported it.

Board Terms
Efficient operations are significantly hindered by annual changes in the board. This measure was placed on the ballot as an option to address this issue and add stability in the Canyon Lake POA’s governance. If approved, the amendment would establish 4-year terms with a 2-year waiting period for Board members starting from the 2025 Annual Meeting & Election of Directors. Subsequent elections would then occur every two years, fortifying governance tenure, establishing stability within the Canyon Lake POA organization, lessen the presence of election signs, and reducing costs by 50%. The community would only see and experience election signs and campaigning every other year instead of every year.
Results: 679 in favor, and 399 against. This measure passed as a majority supported it.

The IRS Revenue Tax Ruling 70-604 allows associations to avoid a tax consequence on any inadvertent excess member income that is applied to the following Fiscal Year (FY) assessment when filing a tax return Federal Form 1120. This IRS Ballot Measure is considered an annual industry standard to allow for clear tax filing authorization should the Board decide to apply excess income to the following year’s assessment.
Results: 1,027 in favor, and 74 against. This measure passed as a majority supported it.

2023 Ballot Measures
IRS Revenue Rule 70-604 Measure Results
The IRS Revenue Tax Ruling 70-604 allows Associations to avoid a tax consequence on any inadvertent excess member income that is applied to the following Fiscal Year (FY) assessment when filing a tax return Federal Form 1120. The proposed IRS Ballot Measure is considered an annual industry standard to allow for clear tax filing authorization, should the Board decide to apply excess income to the following year’s assessment. Though the Association recognizes three options for application of excess income, ((1) refund to the membership, (2) apply to following year’s assessments/operational budget or (3) apply to the reserves) this ballot measure only pertains to the option of applying excess income to the following year’s assessment.
Results: 1,313 in favor and 74 against. The majority were in favor of this measure.
